1. Definitions

For the purposes of these Terms and Conditions:

• "We," "Our," or "Us" refers to tidemione, the yacht charter operator
• "You," "Your," or "Guest" refers to the individual or entity booking our services
• "Services" refers to yacht charter services and related offerings
• "Vessel" refers to any yacht, catamaran, or boat used in providing services
• "Charter Agreement" refers to the binding contract formed upon booking confirmation
• "Website" refers to tidemiones.life and all associated pages

2. Acceptance of Terms

By accessing our website, making an inquiry, or booking our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

These terms constitute a legally binding agreement between you and tidemione. We reserve the right to modify these terms at any time, with changes becoming effective upon posting to our website.

Continued use of our services after changes are posted constitutes acceptance of the modified terms.

3. Eligibility and Capacity

You must be at least 18 years of age to book our services. By booking, you represent and warrant that you have the legal capacity to enter into a binding contract.

If you are booking on behalf of others, you confirm that you have authority to bind those individuals to these terms and are responsible for their compliance.

4. Booking and Confirmation

4.1 Booking Process

Charter bookings are made through direct contact with tidemione via phone, email, or our website contact form. A booking becomes confirmed only upon receipt of written confirmation from us and payment of the required deposit.

4.2 Deposit and Payment

• A deposit of 50% of the total charter fee is required to secure your booking
• The remaining balance is due 14 days before the charter date
• Failure to pay the balance on time may result in cancellation without refund of deposit
• Payment can be made via bank transfer or approved credit cards
• All prices are quoted in Thai Baht (THB)

4.3 Charter Details

Upon booking confirmation, you will receive details including vessel assignment, departure time, meeting location, and crew contact information. These details are subject to operational adjustments with prior notice.

5. Cancellation and Refund Policy

5.1 Cancellation by Guest

• Cancellations 30 days or more before charter date: Full refund minus 10% administrative fee
• Cancellations 15-29 days before charter date: 50% refund
• Cancellations 7-14 days before charter date: 25% refund
• Cancellations less than 7 days before charter date: No refund

5.2 Cancellation by tidemione

We reserve the right to cancel charters due to unsafe weather conditions, mechanical issues, or force majeure events. In such cases, you will receive a full refund or the option to reschedule without penalty.

5.3 Weather-Related Modifications

The captain has final authority to modify routes, shorten voyages, or postpone departures based on weather and sea conditions. Such operational decisions prioritize safety and do not constitute grounds for refund, though we will make reasonable efforts to provide alternative arrangements.

6. Guest Responsibilities

6.1 Conduct

You agree to:

• Follow all instructions from the captain and crew
• Behave in a respectful manner toward crew and other guests
• Not engage in illegal activities aboard the vessel
• Refrain from excessive alcohol consumption that impairs judgment or safety
• Not bring prohibited substances aboard the vessel
• Respect the vessel and its equipment, using items as intended

6.2 Passenger Information

You must provide accurate information regarding the number of guests, ages of children, medical conditions that may affect participation, and dietary restrictions. Failure to disclose relevant information may affect our ability to provide appropriate services.

6.3 Arrival and Departure

You are responsible for arriving at the designated meeting location on time. We cannot guarantee adjusted itineraries for late arrivals, and no refunds will be provided for missed departures due to guest tardiness.

7. Safety and Liability

7.1 Safety Compliance

All vessels operate in accordance with Thai maritime safety regulations. Safety equipment, including life jackets, is provided and must be used as directed by crew. You agree to participate in safety briefings and follow emergency procedures.

7.2 Assumption of Risk

Yacht charter activities involve inherent risks associated with maritime travel. By participating, you acknowledge these risks and assume responsibility for your decision to participate. We recommend travel insurance covering maritime activities.

7.3 Insurance

tidemione maintains comprehensive marine insurance covering vessels and passenger liability. This insurance does not cover your personal belongings or medical expenses. You are responsible for obtaining appropriate personal insurance.

7.4 Medical Conditions

You must disclose any medical conditions that could be affected by maritime activities or that crew should be aware of in case of emergency. We reserve the right to refuse service if we determine a guest's condition poses safety risks.

8. Limitation of Liability

To the fullest extent permitted by law, tidemione's liability for any claims arising from charter services is limited to the amount paid for the specific charter in question.

We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of enjoyment, emotional distress, or lost opportunities.

We are not responsible for delays, cancellations, or modifications caused by weather, mechanical issues beyond our reasonable control, or force majeure events including natural disasters, political instability, or pandemic-related restrictions.

Personal belongings brought aboard vessels are your responsibility. We are not liable for loss, theft, or damage to personal items.

9. Intellectual Property

All content on our website, including text, images, logos, and design elements, is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our written permission.

Photographs or videos taken during charters may be used by tidemione for promotional purposes unless you explicitly opt out at the time of booking.

10. Indemnification

You agree to indemnify and hold harmless tidemione, its owners, employees, and crew from any claims, damages, or expenses arising from your violation of these terms, your negligent or willful misconduct, or your violation of any rights of third parties during charter services.

11. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, acts of government, war, terrorism, pandemic, or other force majeure events. In such cases, we will work with you to reschedule or provide appropriate refunds.

12. Dispute Resolution

12.1 Governing Law

These Terms and Conditions are governed by the laws of Thailand. Any disputes shall be subject to the exclusive jurisdiction of the courts of Phuket, Thailand.

12.2 Informal Resolution

12.3 Arbitration

If informal resolution fails, disputes may be submitted to binding arbitration under Thai Arbitration Institute rules, conducted in English in Phuket, Thailand.

14. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms and Conditions, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and tidemione regarding charter services and supersede all prior communications and agreements.
